SCOPE
Who these terms cover
These terms apply to a business or organization (“you”) that subscribes to the BOSSMAKER white-label platform for its own brand. They apply in addition to BOSSMAKER's other terms and the platform legal disclosures. Individuals who use BOSSMAKER directly, without a subscribing organization, are not covered by these terms; their accounts are described under individual accounts.
YOUR CLIENTS
Your client relationships belong to you
BOSSMAKER treats each partner organization's client relationships, client lists and client contact information as that organization's confidential business information and property. BOSSMAKER will not, and will not allow any other partner organization, advisor, broker, BAMA or third party to:
- access, view, search or export the clients of one organization from another organization's account;
- contact, solicit or market to your clients in order to offer competing services or move them to another advisor or organization;
- sell, rent, license or share your client list or client contact information; or
- attempt, or help anyone attempt, to do any of these things.
BOSSMAKER uses your clients' account information only as needed to operate, secure and support the platform, to carry out work you request or approve (including BAMA assistance), to process billing, or as required by law. Everyone at BOSSMAKER who handles that information is bound by confidentiality obligations. The platform enforces this separation: each organization's clients are walled off from every other organization by role-based access controls.
This commitment does not limit a client's own rights. Each client controls their own personal and financial information, decides what to share and with whom, and may close their account or choose a different professional on their own initiative. General notices BOSSMAKER sends to all users about the service, security or their accounts, and advertising not directed at your clients, are not solicitation.
This commitment continues after your subscription ends.
FEES
What you pay
Your subscription has three parts: a one-time setup fee, generally between $150 to $1,500 depending on your plan and the size of your organization and always shown to you before you pay; a monthly platform fee; and a monthly client fee for your clients who have an activated account. On the Community plan the platform fee is $99 and the client fee uses volume pricing: $10 each for the first 50, $7 each for clients 51-250, and $5 each above 250. For example, 200 activated clients cost 50 at the first rate plus 150 at the second. On an Advisory plan the platform fee includes a set number of client households (Advisory Starter $599 with 20, Advisory Professional $899 with 30, Advisory Enterprise $1,500 with 50), and each activated client above that number costs $25 a month. Founders' status: the first 50 organizations to activate an Advisory plan each hold a founders' seat, and the founders phase closes once every seat is taken. A seat holder on the Enterprise plan pays a founders' rate of $1,250 a month instead of $1,500 for its platform fee for its first 12 billed months (a free trial does not count toward them), counted from activation or, for a seat holder who moves up to Enterprise, from that change; after that the standard platform fee applies. The founders' rate applies only to the Enterprise platform fee, does not apply while the organization is on another plan, does not extend the 12 months, is given once per organization (cancelling and subscribing again does not restart or resume it), and can be combined with the church and nonprofit rate. On the Community plan your clients receive the Essential Report; a client may buy the full report for $99, and you may buy it for a client, in which case $99 is charged at once to the card on file for your subscription. Each full report covers 12 months of updated full reports for that client and is non-refundable except as described under “Refunds”. On an Advisory plan your clients receive the full report. A church or tax-exempt nonprofit receives 25% off its client fees once BOSSMAKER has reviewed and approved its proof of status: its legal name, EIN, and state, and its IRS determination letter (a church without a letter may confirm its status instead). The platform fee and setup fee are not discounted. You must tell BOSSMAKER if your status changes; the discount ends from the next bill after an organization no longer qualifies. A client has an activated account once they have created their own login. Clients you upload or invite who have not created a login are not counted. Your plan is shown on your Billing page. If your plan changes, the new platform fee applies from your next billing date. These are founders' introductory prices; they may change as described under “Changes” below. Prices are in U.S. dollars and do not include any sales or similar tax that may apply.
FREE TRIAL
Your 30-day free trial
The first time your organization activates, your subscription starts with a 30-day free trial, with full access to set up your account and invite your clients. You enter a card when the trial starts, and nothing is charged during the trial. When the trial ends, your card is charged the setup fee plus your first month, and your subscription continues as described below. If you cancel before the trial ends, you are not charged. Each organization may have one free trial.
BILLING
Billing and renewal
Your first charge is the setup fee plus your first month, made when your free trial ends (or when you activate, if you have already had a trial). After that, your subscription renews automatically each month on the same date until you cancel, and the card on file is charged in advance for the coming month. Your client count is taken on each billing date; a client who activates during a month is first charged on your next billing date, and there are no part-month charges or credits. Payments are processed by Stripe, and you authorize BOSSMAKER to charge your card for these amounts. Your invoices are available from the Billing page of your administrator dashboard.
FAILED PAYMENTS
If a payment fails
If a charge fails, Stripe will try again, and you will be asked to update your card. You keep full access for 7 days after the first failed payment. After that, your administrator dashboard is paused until payment is made. Your clients keep access to their own accounts while your dashboard is paused. If payment is still not made after the retries, your subscription may be canceled.
CANCELLATION
Canceling your subscription
You can cancel at any time from the Billing page of your administrator dashboard (“Manage card and invoices”). Cancellation takes effect at the end of the month you have already paid for; you keep full access until then and are not charged again. Canceling does not delete your clients' accounts, and your clients keep access to their own information. If you subscribe again later, you will not be charged a second setup fee. BOSSMAKER may suspend or end a subscription that breaches its terms or the law.
BAMA SUPPORT
BAMA support on Advisory plans
A BAMA is a certified BOSSMAKER Account Management Assistant. BAMAs help with navigation, setup, client campaigns, progress monitoring and follow-up. They do not give financial, tax, insurance or legal advice, never see your clients' financial details, and call your clients only with your permission.
Every organization on an Advisory plan (Starter, Professional or Enterprise) receives one included 30-minute BAMA launch session. Enterprise also includes ongoing BAMA support.
On Starter and Professional you may add BAMA Plus, ongoing BAMA support billed with your subscription: $199 a month on Starter and $249 a month on Professional, starting with your next monthly bill. An organization holding a founders' seat (see “What you pay”) receives $50 off BAMA Plus each month for its first 12 months of BAMA Plus. Moving to Enterprise, which includes ongoing BAMA support, ends BAMA Plus; moving between Starter and Professional changes it to that plan's price. You may remove BAMA Plus at any time from your Billing page; it stops right away and the current month is not refunded. BAMA Plus ends when your subscription ends.
You may also book single 30-minute BAMA sessions for $49 each, added to your next monthly bill. If BOSSMAKER cancels a session and cannot reschedule it, the charge is removed or refunded. Sessions are scheduled according to BAMA availability.
REFUNDS
Refunds
Fees are non-refundable, including the setup fee and any month that has started, except where a refund is required by law. If you are charged in error, for example twice for the same month, tell us within 30 days of the charge through the Help page and we will refund the amount charged in error. Please contact us before disputing a charge with your card issuer so we can resolve it directly.
CHANGES
Changes to prices and these terms
BOSSMAKER may change its prices or these terms. We will give you at least 30 days' notice by email before a change takes effect, and a price change will apply from your first billing date after the notice period. If you do not agree to a change, you can cancel before it takes effect. Continuing your subscription after a change takes effect means you accept it.
